Hurricane Daniel in Libya and the Erosion of Civil Rights for Its Victims’ Families

Despite more than a year having passed since the disaster of Hurricane Daniel, which struck the city of Derna, leaving behind thousands of deaths and disappearances according to initial estimates, the final toll of this catastrophe remains unknown. This includes the number of those missing, whose fate is still uncertain. This situation raises issues regarding the civil rights of their families, as Libyan law considers a missing person legally deceased after four years have passed without any information about them. This extended period could pose numerous challenges for the families of the missing.

Summary of the Proposal:

The report addresses the legal and religious perspectives on the issue of the missing, along with the associated civil rights, such as inheritance, the status of the widowed spouse, compensation matters, and reparation for those whose properties and homes were destroyed.
